Welcome to SmartInspect ("we," "us," or "our"). By accessing or using our fabric quality analysis service at smartinspect.in (the "Service"), you agree to these Terms & Conditions. Please read them carefully.


1. About SmartInspect

SmartInspect provides automated fabric quality analysis powered by computer vision and machine learning. Our Service enables you to:

  • Upload high-resolution fabric images for rapid EPI (Ends Per Inch) and PPI (Picks Per Inch) estimation
  • Benefit from automatic fabric orientation correction
  • Get individual yarns numbered for manual review when needed
  • Receive results in seconds instead of manual counting that takes 10+ minutes
  • Verify already known warp and weft yarn counts with your sample measurements
  • Calculate the average count for warp and weft yarns

The Service uses a token-based system where analyses cost tokens. Please check our Pricing page for current token costs.


2. Account Registration & Eligibility

2.1 Who Can Use SmartInspect

  • You must provide accurate information during registration
  • You represent that you have the authority to enter into this agreement
  • By creating an account, you agree to comply with these Terms

2.2 Your Account Responsibilities

  • Keep your login credentials secure and confidential
  • You are responsible for all activities under your account
  • Notify us immediately at admin@smartinspect.in if you suspect unauthorized access
  • If you forget your password, contact us at admin@smartinspect.in for assistance

3. Token System & Payments

3.1 How Tokens Work

Trial Users: - Receive 250 locked tokens upon registration to test the Service - Must request token unlocking by clicking "Request Token Unlock" button - Once unlocked by admin, trial tokens can be used for analysis

Premium Users: - Can purchase additional tokens at the rate of 1 Rupee = 1 Token - Purchased tokens are immediately available for use - No limit on token purchases

Token Costs: - Please refer to our Pricing page for current token costs per analysis type - Token pricing may be updated with advance notice via email and dashboard notification

3.2 Payments for Token Purchases

  • All payments are processed in Indian Rupees (INR) through secure third-party payment gateways
  • We do not store your complete payment card details
  • Pricing is subject to change with reasonable advance notice

Important: Payments made to purchase tokens are generally non-refundable, except in the following exceptional circumstances: - Complete failure to provide the Service after payment - Technical issues preventing token credit to your account - Duplicate charges or payment processing errors - Other exceptional circumstances at our sole discretion

3.3 Token Validity

  • Tokens do not expire while your account remains active
  • Unused tokens remain in your account for future use
  • Trial account tokens remain locked until you request unlocking and receive admin approval
  • There is no time limit for using purchased tokens

4. Refund Policy

We want you to be satisfied with SmartInspect. We have two types of refunds:

4.1 Token Refunds (Service Credit)

You may request a token refund (credits returned to your account) if:

  • Technical Errors: The system fails to process your image due to our technical issues and your tokens were deducted
  • Clearly Inaccurate Results: Results are demonstrably incorrect due to system error, not image quality issues
  • Service Unavailability: Analysis failed to complete due to server errors or downtime
  • Incorrect Token Deduction: Tokens were charged incorrectly for an analysis

Note: - If you notice unexpected token deductions, report the issue immediately.

4.2 Money Refunds (Cash Return)

Refunds of actual money paid to purchase tokens are generally not available except in these exceptional circumstances:

  • Payment Processing Errors: You were charged but tokens were not credited to your account
  • Duplicate Payments: You were accidentally charged multiple times for the same transaction
  • Service Failure: Complete inability to use the Service after purchasing tokens due to technical issues on our end
  • Unauthorized Charges: Fraudulent charges on your account (subject to verification)

Money refunds are NOT available for: - Change of mind after purchasing tokens - Inability to use tokens due to poor image quality - User error or misunderstanding of Service features - Business or project requirements changing

4.3 How to Request a Refund

For Token Refunds: 1. Use the refund request feature on the result page of each upload 2. Provide a complete description of the problem 3. Refund requests are reviewed within 2 business days 4. Approved token refunds are credited back to your account immediately

For Money Refunds: 1. Contact us at admin@smartinspect.in with: - Your account email - Transaction ID or payment receipt - Complete description of the issue - Supporting evidence (screenshots, error messages) 2. Money refund requests are reviewed within 5-7 business days 3. Approved refunds are processed back to your original payment method within 7-10 business days

If refunds are not processed within the stated timeframe, escalate to admin@smartinspect.in

4.4 Refunds Are NOT Available For

  • Poor image quality or images that don't meet our requirements
  • User error, incorrect usage, or misunderstanding of features
  • Changes in your project requirements or business needs
  • Results that include automatic reliability warnings (system is working as intended)
  • Analysis that completes successfully but doesn't meet user expectations

5. Image Upload Requirements

For accurate analysis, uploaded images must meet these specifications:

5.1 Fabric Images

  • Resolution: High-resolution strongly recommended (ideally 9000×6752 pixels captured with industrial microscope cameras)
  • Format: JPEG (Recommended) or PNG
  • Quality: Clear, well-lit, properly focused, without obstructions or blur
  • Device: Should be captured with industrial microscope camera such as DKP Medicam or equivalent high-quality imaging device

5.2 Calibration Images (Compulsory)

  • Must include a 0.5 square inch calibration square
  • Square should be clearly visible, printed in black color on white paper
  • Square edges must be clean and unbroken (broken edges will cause analysis to fail)
  • Must be captured from the same distance and with the same device as the fabric image
  • Square should be properly aligned, not rotated

5.3 Your Responsibilities

  • You own or have permission to upload all images
  • Images do not infringe on third-party intellectual property rights
  • Images do not contain harmful, illegal, or inappropriate content
  • You ensure images meet the technical requirements listed above
  • Read and understand the user manual available on our platform.

6. How We Use Your Images

6.1 Processing & Storage

  • Images are processed using our proprietary computer vision algorithms
  • We retain images for your verification, analysis history, and dispute resolution purposes
  • You can delete your images at any time from your account dashboard
  • Users are encouraged to delete image data once it's no longer needed

6.2 Storage Management

Important Storage Policy: - Users should manage their stored images responsibly - If your total analyzed images exceed 300 uploads, you must delete older images to free up space - Failure to manage storage may result in us deleting older images to maintain platform performance - We will provide warnings before deleting any user data - Critical images should be downloaded for your records before deletion

6.3 Your Rights

  • You retain full ownership of all uploaded images
  • We do not use your images for marketing purposes
  • We will not share your images with third parties without your explicit permission
  • We may use anonymized, aggregated analysis data (without images) to improve our algorithms
  • You can request complete deletion of your images and data at any time

7. Acceptable Use

You agree to:

  • Use the Service for lawful purposes related to fabric quality analysis and textile industry quality control
  • Not attempt to reverse-engineer, decompile, hack, or compromise the Service
  • Not upload malicious code, viruses, or harmful content
  • Not use automated bots or scripts to abuse or overload the Service
  • Not resell or commercially redistribute the Service without our written authorization
  • Not share your account credentials or tokens with unauthorized users

Commercial Use: Using SmartInspect for your textile business quality control is permitted and encouraged. However, reselling our Service as your own product or white-labeling without a partnership agreement is strictly prohibited.


8. Service Availability & Accuracy

8.1 "As-Is" Service

  • SmartInspect is provided "as is" without guarantees of perfection
  • We strive for high accuracy but cannot guarantee 100% accuracy in all cases
  • The system provides automatic warnings when results may be unreliable
  • Results should be verified using the numbered yarn markings for critical quality control decisions

8.2 Service Availability

  • We aim for maximum uptime but cannot guarantee uninterrupted service
  • Scheduled maintenance, updates, or technical issues may cause temporary unavailability
  • We will notify users in advance of scheduled maintenance when possible
  • We are not liable for business losses due to service interruptions

8.3 Your Verification Responsibility

  • All analysis results include individually numbered yarns for manual review.
  • You are responsible for verifying critical measurements before making business decisions
  • Use SmartInspect as a tool to assist, not completely replace, your quality control processes
  • When in doubt, manually verify the marked yarns in the result images

9. Intellectual Property

9.1 Our Property

  • The Service, including algorithms, software, analysis methods, and technologies, are our intellectual property
  • SmartInspect trademarks, and branding are protected under applicable laws
  • Any proprietary features or innovations are owned by SmartInspect

9.2 License to You

We grant you a limited, non-exclusive, non-transferable, revocable license to: - Use the Service for personal or business fabric quality analysis - Download and use your analysis results for your business purposes - Access the Service according to these Terms - Share results within your organization

This license automatically terminates if you violate these Terms.


10. Limitation of Liability

To the fullest extent permitted by law:

10.1 Disclaimer of Liability

We are not liable for: - Indirect, consequential, incidental, special, or punitive damages - Loss of profits, revenue, data, or business opportunities - Business interruption or loss of goodwill

10.2 Maximum Liability

Our total liability to you for any claims is limited to the amount you actually paid us in the past 12 months.

10.3 Specific Disclaimers

We are not liable for losses due to: - Your image quality, upload errors, or failure to meet requirements - Internet connectivity issues or network problems - Third-party service failures (payment gateways, cloud storage) - Your reliance on analysis results without proper verification - Decisions made based on SmartInspect results without independent verification

10.4 Indemnification

You agree to indemnify and hold us harmless against any claims, damages, or expenses arising from: - Your uploaded images and their content - Your violation of these Terms - Your use or misuse of analysis results - Any negligence or misconduct on your part


11. Account Termination

11.1 Your Rights to Close Account

  • You may close your account at any time by contacting us at admin@smartinspect.in
  • Upon voluntary account closure, unused tokens are forfeited and cannot be refunded
  • We encourage you to use remaining tokens before closing your account
  • We will delete your personal data as per our Privacy Policy upon account closure
  • Image data will be permanently deleted within 30 days of account closure

11.2 Our Rights to Terminate

We may suspend or terminate your account if you: - Violate these Terms repeatedly or seriously - Engage in fraudulent activity or payment disputes - Abuse the Service, upload inappropriate content, or harass others - Repeatedly use free trial accounts to avoid purchasing tokens for ongoing business use - Attempt to hack, reverse-engineer, or compromise the Service

Notice: We will provide advance notice when possible, but may terminate immediately for serious violations or security threats.

11.3 Effect of Termination

Upon account termination: - Your access to the Service is immediately revoked - All unused tokens (trial or purchased) are forfeited without refund - You must cease all use of SmartInspect - Your analysis history and uploaded images will be deleted - Any outstanding payments become immediately due


12. Changes to Terms

12.1 Updates

  • We may update these Terms from time to time to reflect changes in our Service, legal requirements, or business practices
  • Changes will be posted with a new "Last Updated" date at the top of this page
  • Significant changes will be notified via:
  • Email to your registered email address
  • Dashboard notification when you log in
  • Prominent notice on the website

12.2 Your Acceptance

  • Continued use of the Service after changes are posted constitutes your acceptance of the updated Terms
  • If you do not agree with the changes, you must stop using the Service
  • We recommend reviewing these Terms periodically

13. Dispute Resolution

13.1 Governing Law

These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

13.2 Dispute Resolution Process

Before filing any legal claim, we encourage the following process:

  1. Contact Us: Email admin@smartinspect.in with a detailed description of the issue
  2. Good Faith Discussion: We will work in good faith to understand and address your concerns
  3. Negotiation: Many issues can be resolved through open communication and reasonable negotiation
  4. Timeline: We aim to respond to disputes within 5-7 business days

We believe most disagreements can be resolved without litigation.

13.3 Jurisdiction

If a dispute cannot be resolved through negotiation, any legal proceedings must be filed exclusively in the courts of Gurugram, Haryana, India. Both parties consent to the jurisdiction of these courts.


14. General Terms

14.1 Entire Agreement

These Terms, along with our Privacy Policy, constitute the complete and exclusive agreement between you and SmartInspect regarding the Service. They supersede any prior agreements or understandings.

14.2 Severability

If any provision of these Terms is found to be invalid or unenforceable by a court, the remaining provisions will remain in full force and effect.

14.3 No Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision. Any waiver must be in writing and signed by us.

14.4 Assignment

  • You may not transfer, assign, or delegate these Terms or your account to anyone without our written consent
  • We may assign our rights and obligations under these Terms with reasonable notice to you
  • These Terms bind and benefit both parties and their successors

14.5 Force Majeure

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, pandemics, internet failures, or government actions.

By creating an account and using SmartInspect, you acknowledge that:
